Terms and Conditions
1. General Provisions
1.1. The following terms and conditions of sale (“Terms of Use and Conditions of Sale”) apply to the offer and sale of tourist services through the website www.kuelapadventure.com.
1.2. In order to purchase and/or reserve a tourist service from the website, customers must:
(a) Be at least 18 years of age or, if minors, be duly authorized by their legal guardian;
(b) Be consumers, meaning natural persons acting for purposes unrelated to their industry, trade, business, or profession;
(c) Register on the website (optional);
(d) Have a valid credit card (optional)
1.3. This contract will be formalized in Spanish and will be governed by the Peruvian Consumer Protection Law.
2. Seller Identification
The seller is Kuelap Adventure Travel and Tourism Agency – E.I.R.L, with registered address at Pasaje Santa Lucia 177 – Chachapoyas – Amazonas – Peru, with Unique Taxpayer Registration Number (RUC) No. 20480443790.
3. Tourist Services.
The tourist services described on the website and any samples thereof that we provide to the client are for personal use only. Clients may not sell or resell such services. We reserve the right, with or without notice, to cancel or reduce the quantity of services or samples to be delivered to the client when, in our sole discretion, this constitutes a breach of these Terms and Conditions.
4. Prices
All prices indicated for products available through the website include applicable taxes and are denominated in soles and dollars.
5. Booking a tourist service:
To make a reservation, the customer must follow a series of simple instructions on the website. To request a reservation, the customer must correctly fill out the booking form, which will be confirmed by the agency representative as quickly as possible, but no later than 48 hours.
5.1. For online reservations, the customer must click “Add to Cart” to place the selected product and the desired quantity in the shopping cart. The customer can check the services included in the shopping cart at any time during the purchasing process by clicking “Order” on each page. The customer can save a product to their favorites by clicking “Add to Favorites” below the product name, after which the product will be added to the customer’s favorites section in “My Account.” To access a customer’s favorites from any computer, the customer must register or log in with their account.
5.2. The Customer must follow the on-screen instructions to complete the checkout process. The Customer may always correct any errors in the information entered, change the contents of the shopping cart by adding or removing one or more products from the cart, or cancel the entire order during the checkout process before placing the order. By placing an order, the Customer acknowledges and declares that they have read all instructions given during the checkout process and fully accepts these Terms and Conditions. The Customer places an order for products through the Website by clicking the Submit button at the end of the order process.
5.3. Once the order has been submitted, a “Thank you for placing your order in the Online Store” page will appear, and the Customer will shortly receive an email confirming receipt of the order. The order confirmation email contains a summary of the Terms and Conditions, information on the essential characteristics of the purchased products, a detailed indication of the price and payment method, information on shipping costs, information on the conditions and methods for exercising the right of withdrawal, the address for submitting complaints, and information on support services and commercial guarantees.
5.4. If an order confirmation does not arrive within 48 hours of placing it, the customer may contact us for assistance by calling 941441442.

For faster service, customers are encouraged to have their order number available.
6. Offer Codes:
6.1. To redeem an offer code, the customer must enter the code in the “Promotional Code” box during the checkout process on the website. Offer codes are case-sensitive and must always be entered exactly as they appear.
6.2. When an offer code is accepted, the offer will be displayed in “Order Review.”
6.3. One offer code may be used per order.
7. Payment Options:
7.1. The customer may pay for tour services by credit card. The following credit cards are accepted: Visa / MasterCard / American Express / Dinners Club / Bank Transfer / PayPal / Western Union / MoneyGram.
7.2. For customer security, the customer’s name and billing address must match the credit card used for payment. We reserve the right to cancel any order that does not meet these criteria.
7.3. All credit card holders are subject to validation checks and authorization by the card issuer. If the customer’s payment card issuer denies or for any reason does not authorize payment to us, either before or after a payment, we will not be liable for any delay or non-delivery.
8. Reservation Questions:
8.1. For reservations requested online through the website, the reservation and confirmation are immediate. The confirmation is automatically sent to the email address you entered when completing the payment and reservation form. In some cases, the email arrives as spam, so you should check your spam folder.
8.1. Reservations generated through the traditional method are generally sent a few hours after receiving a reservation. 8.2. Occasionally, our system cancels reservation requests or parts of a reservation for various reasons. Some of these reasons include:
· Unavailable tourist services
· Unable to process payment information
· Duplicate order placement
· Cancellation at the request of a customer.
8.3. If an order is canceled, the customer will receive an email explaining the reasons for the cancellation. The customer will not be charged for canceled orders. 9. Confirmación de reserva:
9.1. Las reservas solicitadas vía web a través del carrito de compras la confirmación de las mismas es inmediata, la cual podrá verificarse mediante los correos electrónicos que son enviados a su bandeja (verificar correos no deseados)
Las reservas se tramitan y entregan exclusivamente en días hábiles (lunes a sábado, sin incluir días festivos). Los pedidos efectuados el sábado después del medio día y domingo se tramitarán el siguiente día hábil.
9.2. No podemos tramitar reservas si el formulario de reserva está mal llenado, con dirección de correo falsa o mal escrita, número de teléfono inexistente, fecha mal definida.
9.3. Por tratarse de un servicio intangible no se cobra gastos de envío.
9.4. De acuerdo con la Ley del Consumidor, los servicios se entregarán dentro de las fechas mes y año que el cliente ha seleccionado en el formulario de reserva y éste haga sido confirmado por el aérea correspondiente o en caso de no ser posible atender la reserva en la fecha seleccionado, la agencia comunicará vía correo electrónico las fechas alternativas quedando en plena libertad del cliente aceptar o no la nueva propuesta.
10. Right to Cancel a Reservation (Withdrawal)
10.1. We are committed to offering our clients the best tourist services available. If the client believes that the services they have booked do not meet this expectation, they have the right to withdraw from the contract, without giving any reason, within 30 (thirty) days of receiving the reservation confirmation.
10.2. The client may notify us of their intention to exercise the right of withdrawal by sending us an email to gerencia@kuelapadventure.com with the details of the requested reservation, including the reservation number or code.
10.3. Our Customer Service department will then issue the client an authorization number and an email confirmation.
10.4. If the right of withdrawal is exercised, we undertake to refund the client the price of the reserved and paid service within five (5) calendar days of receiving their notification of withdrawal. We reserve the right to retain a percentage of the client’s refund for administrative expenses, in addition to any payments made by the agency to suppliers involved in the tour operation. Refunds will only be issued to the original credit card or by bank transfer. Once the refund has been issued, we will notify the client by email.
11. Applicable Law and Jurisdiction
11.1. These Terms and Conditions are governed by Peruvian law and must be interpreted in accordance with Peruvian law.
11.2. Any disputes arising from the interpretation, validity, and/or enforcement of these Terms and Conditions shall be subject to the jurisdiction of the courts and tribunals of Chachapoyas.
